Not at all, perhaps criminally negligent but not responsible - the perpetrator
is the one criminally responsible.  By any logical measure.

  Actually a better analogy would be, what if you had the power AND the
  authority to prevent the act.
  Would it not be understandable for the victim's family and relatives to
  term you as 'Criminally Responsible'.
