non-compete would be moot, because there is noone to be in competition with.
On the other hand, if your agreement passed exclusive license of the code, then
you would still be bound to not re-distributing or re-using that code without
license from the owner.
A rather far out example of this is the case of SCO who has failed in their
regular line of business of selling UNIX, and instead has re-distributed their
stock to law firms and it appears their new business plan is to make a living on
litigation and trying to extort license fees from the Linux community
