when the email that is sent is unsolicited or in the case of mailing lists, 
is not of subject matter related to the list.

As long as I have been a member of this mailing list (3+ years i think) 
people have always sent notice of availability.

I do not consider this spam at all.

Unless, and this is entirely possible, I am missing something (ie. this 
message has been sent 10 times)
