Incedentally, this _sounds_ to me like a bug. The syntax of the query certainly looks good -- I can't imagine it not working on CF 3.0-5.0 for Windows. What OS / CF version are you using? You might try removing the # symbols in your <cfif> statement -- they're not necessary within cf tags and I suppose theoretically could be causing a problem. That's pure conjecture tho.
