Yes I think the best solution is to ask x264 devs.
Before writing this patch I had a look at how it has been fixed in other softs, and for the ffmpeg part included in cinelerra it's how it has been fixed by ffmpeg devs. The part I had to think more about is the quicktime part, but it should be similar to the fixes I've seen.
You might also want to have a look at [1] to see how the api changed, and I agree that's strange to replace cbr by abr...
