could be its missing it's weight   
i.e a weighted default gateway to prevent it dropping the packet if the
interface is not up 
         ip route 0.0.0.0 0.0.0.0 162.16.40.2
         ip route 0.0.0.0 0.0.0.0 162.16.20.1 3   3 being the weight
