Re: gardeners want the developer to do a human health risk assessment.

Being a paralegal now: If the State of California certified the Ron Mandella
Garden as being polluted enough to condemn it for gardening, there should be
reports on file with your municipality and the California State EPA. These
report should be available by making a State of California Freedom of
Information ("FOI") request. Is it the State of California or the developer
who is required by law to make a human health risk assessment?

Also, I don't know what the nature of your gardener's law suit is (loss of
the community garden, exposure to pollutants, etc.) but I think they should
engage counsel competent in U.S. and California environmental law.

Update: not the best news to give....but here it is....

Sacramento's first community garden 30 years old, has been given orders to
remove all personal items by nov 18...high levels of contaminents have been
found...the site will be 
pad locked for non-use till it is developed planned for spring 03.

The State owned land is planned to be used for some apts, condos, & small
shops... a portion of the garden (approx 1/3) will be cleaned (soil removed
and new soil imported) and still remain a garden for the residents of the
condos and some for the neighborhood....gardeners want the developer to do a
human health risk assessment.  Gardeners also looking at other options
including lawsuits.
