Being a paralegal now: If the State of California certified the Ron Mandella Garden as being polluted enough to condemn it for gardening, there should be reports on file with your municipality and the California State EPA. These report should be available by making a State of California Freedom of Information ("FOI") request. Is it the State of California or the developer who is required by law to make a human health risk assessment? Also, I don't know what the nature of your gardener's law suit is (loss of the community garden, exposure to pollutants, etc.) but I think they should engage counsel competent in U.S. and California environmental law.
