Patty, you've pulled me out of lurk-dom on this one. 
Yes, they're doing this in a good number of places, as has been shown by the 
publications articles searches I've had on the topic of community gardens.
In my own experience, I've wanted to start a little bicycle cart business in 
Baltimore County, and you wouldn't believe the bureaucratic chain of people I 
went through to find out that there really are no laws on the books for bicycle 
businesses.  But, the end all of conversations with County and State Gov was 
that I'd need to photograph the cart, the bike and myself, no woody 
ornamentals, and apply yearly for a Huckster's license and follow by those 
rules.  
Anyhow, my husband had this to say about your information..

Even your own backyard garden is going to be against the law".

alert in yours
  

Hi, all.  Just wanted to remind you to stay on top of any zoning 
ordinance rewrites or changes happening in your city. The draft 
circulating in my city included a section that literally made donating 
crops from community gardens illegal if the gardens are located in parts 
of the city that don't allow commercial activity (in my city, that would 
be include just about all the parks, churches, and schools). If some of 
us hadn't noticed this detail and spoken up about it, this would have 
been the law. We have a large community garden, a robust food pantry 
garden, and numerous school gardens that donate to those in need that 
would have been directly affected.
