My Garmin 12 XL manufactured 2 years ago had no such speed restriction. It did develop some problems within the warranty period and Garmin replaced the unit free of charge and it even had some upgrades. Living within 25 miles of Garmin and hand carrying the unit in, granted no special privileged. Still had to wait a few days for their replace/repair decision.
