addendum:

something i should have done a while ago - i went
and looked at the permissions of the files in the
maildir. suprise! i found a couple of messages with
        strange permissions:

-rw-rw---- 1 jenn mail 11509 Sep 10 01:01
1063170063.13421.c3po.futureconsortium.com:2,
-r--rwx--- 1 jenn mail 8535 Sep 10 01:05
1063170330.13429.c3po.futureconsortium.com:2,
-rw-rw---- 1 jenn mail 6712 Sep 10 01:11
1063170677.13437.c3po.futureconsortium.com:2,

hmmmm... any ideas what could be changing the message
permissions like that? i tried downloading mail with
thunderbird, same error, but by now i wasn't too
        surprised. i chmod-ed g+rw & u+rw for those messages
(there was one other with even stranger permissions)
and things seem to work now.

        note: i'm running exim 3.36-6
