I guess potential industrial vendors (especially those with deep-pocket disease :-) aren't as keen on defending themselves in court trying to invalidate those patents... Maybe you know of other reasons, that prevent technology of comparable (to RSA) performance, greater strength and requiring 5 to 10 times less space for keys (not to mention support by NIST and NSA), from completely conquering the market?
