Disney is a existing company. Disney has a lot of money. Disney makes a lot
of money from The mouse. It makes sense  to defend the image of that mouse.
Now haxar from 1981 created by some small company that folded after that
games release and who's primary code writer is dead? People will worry about
copyright in porting that cartridge to an emulator for fun?  Some people
have talked about doing that on forums and have been literally cursed out by
some guy that had NOTHING to do with company or the games creation. That's
just silly.  It may be technically against law but there is nobody around to
bring about a complaint.  So whose being hurt then? NOBODY. Yet pages of
forum debate on its legality coupled with strong language and unfounded
accusations exist in the retro game community. Just like in communities for
programs for VASSAL and CB it has been discussed now and again. If there is
illegality in distrubiting these boxes for download somebody better take
Matrix games to task. They are or in the past have been afflicted with
VASSAL and the distribution of SPI,AH,VG, TSR and other games in many cases
including charts and other text along with artwork for many years now. Yet
there hasn't been a peep about legal action.

 

 AS I stated in the case of companies like Avalanche its totally different.
They have their stand on the issue and they are a functioning company. Of
course that should be respected.

As I understand it, Disney spend an awful lot of lobbying money keeping
Mickey Mouse in copyright, so I suspect unless a large cheque is included in
the letter, this appeal will fall on deaf ears.

Compared to the lifespan of patents, the lifespan of copyright is huge. Life
of the author plus 70 years IIRC.
