I'll get calls from time to time about judicial elections since most
non-lawyers (and many lawyers) don't have a clue about these candidates.
Personally, I like judges that will construe existing law from the bench
rather than create new law from the bench. Below are how these
philosophies are defined:
Black's Law Dictionary defines "judicial activism" as "Judicial
philosophy which motivates judges to depart from strict adherence to
judicial precedent and favor progressive and new social policies which
are not always consistent with the restraint expected of appellate
judges. It is commonly marked by decisions calling for social
engineering and occasionally these decisions represent intrusions into
legislative and executive matters." A related term defined in Black's
is "judicial self-restraint", which is "Self-imposed discipline by
judges in deciding cases without permitting themselves to indulge their
own personal views or ideas which may be inconsistent with existing
decisional or statutory law."
I personally know these folks and believe they'll exercise judicial
self-restraint deciding cases:
NC Supreme Court - Bob Edmunds (running for reelection)
NC Court of Appeals - Linda Stephens (great judge seeking to keep her
seat)
Doug McCullough (running for
reelection)
There are a few other appellate races, but no comment on those. I
encourage you to vote for the folks listed above.
