There's no reason not to include toc2mp3. It breaks no law, and though
LAME is not in Debian, it is packaged and readily available from
debian-multimedia.

The situation is the same as for MP3 support in SoX, for which a patch
has just been accepted allowing the relevant (not in Debian, but
available from debian-multimedia) library to be dlopened. See bug
#382275.
