No it does not - definitely!
It even did not happen under vanilla kernel 2.6.24 until right now.

I am definitely suspecting that too - but the problem here is another one:

Where and how can I get version 1.0.4-5?
Could you send me the appropriate package or an appropriate diff against 
1.0.4-6?
