This is a bug, so please file a bug report against emacs. The policy concerning /usr/local has been changed. The package may create empty directories below /usr/local, but it must not fail if this is impossible (because /usr/local is mounted read-only). This new policy already described in the draft version 2.2.0.0, which will become "official" in the next few days.
