right. Someone with more gradle experience would have to check those

i played a little bit with the wizard and it will keep generating the
wrapper for 8.9 _without_ the tooling-api update which will cause all
kinds of warnings when NB runs on JDK 23.

I debugged through it and it does use "--gradle-version latest", not
sure what is going on there - I can't imagine the tooling API would
hardcode the latest gradle wrapper version?
It doesn't.  Just checked NB23rc2 with a clean userdir and it created
a project with 8.10.

Possibly caching or offline?

I did clear ~/.gradle and testuserdir. But if its working for you - I trust you there :)
