As mentioned, the process for IP clearance is here [1]. If this had been 
followed, I think some of the issues I brought up in the RC vote would have 
been discovered. In this process, the PPMC must first consider what is being 
donated and what, if any, 3rd party code or IP issues it contains.

But to answer the question, is IP clearance strictly needed for a donation to 
an incubating project before graduation? In general, yes, but not always. It is 
required so the project can graduate, and it can still impact releases that 
contain that code before then, but is it strictly required at the point of 
donation? Probably not. However, it is best to do things in the same way that a 
top level project would.
