When you have a frame selected (i.e when it was newly inserted and you use [via main menu] Format-Frame or [via context menu] Frame, then the Frame dialog opens with the last seen tab page. About your scenario: Having a frame selected and choosing [via menu] Insert-frame, you get the same dialog as Format Frame. The frame gets re/formatted according to dialog changes, but it does not replaced (this can be seen when the frame has text in it). So Insert-Frame is not exact in this situation. But a main menu entry can not be changed depending on the context "Frame selected". It is not greyed-out in the insert menu so that the user has another way to access this dialog. This is the same behavior since a long time (I had a look into "pre-OOo" StarOffice 5.2). But you are right that the dialog should open on the last tab page.
