The ARRL represents less than 20% of the licensed hams in the US. Why should 
they be the organization to develop the band plan the other 80% of the 
amateur community is to follow?

If you wait until the regulation is in place before developing a bandplan, the 
*real* bandplan will be determined by ModeWar/PowerWar. There will be  no 
going back once that is decided - unless the FCC puts some policing powers in 
place. They will likely have a hard time giving policing power to an 
organization representing a minor fraction of the total amateur community.
