If you were to provide a challenge against the domain name, wouldn't you win by default if the owning party isn't present due to lack of notification due to misinformation in the WHOIS database?

While it is mandated it is often missing.
 
There is nothing to stop a domain owner from removing or providing false the information once they have access to the control panel.
 
And this is like everything else about ICANN, it is mandated but not enforced.
 
Then the idiots who provide false or incomplete information complain when they do not receive renewal information and lose the domain.  :(
