And if it's WHOIS data they're drawing from, whether it be from and online source,
or a CD, I would think
 it's WHOIS mining.

So do these guys have to be mining the whois data in order to be sending out these mail messages? Can't they buy (or otherwise cut a deal for) the $10,000 whois dire ctory and simply use that as their data source? Isn't that legal? I'm not advocating for it, just about the legality.
