It is very true.  The OpenSRS notice is not now nor has it ever been an
authoritive or required or even optional notice.  In fact, it didn't even
exist for quite a while.  ICANN requires that the gaining registrar get
authoritive permission of the registrant.  If the gaining registrar
doesn't follow through with the requirements, then they should be reported
to ICANN.

We have customers in the same situation all the time wanting to know why
their domain is being transferred to Enom.  Little did they know they gave
DROA permission to do so when they thought they were renewing the domain
via mail.
