So I'm focused on this part:

I had to reread this article several times to resolve the relevant ethical
question for me:
1. Did he go fishing on his own to find information (i.e., similar to sysadmins
reading other's emails)?
or
2. Was he asked to extract the info as part of his official duties for the
State's Attorneys office?
It appears that it was #2, although that does not explicitly jump out from the
article.
If it had been #1, then I would say it is another faulty case of the "end
justifies the means" rationalization.
But instead it *appears* to be #2: he created a report under his official
duties at the request of superiors, and then wondered why it was not made known
to the other party. Assuming that's the case, I trust his attorney will deal
with the unclean hands of his former employer.
