Then it would be helpful to the industry to attempt to get that ISP to change it's behavior.

Whether it would help to issue a BCP, which explicitly directs receivers not to factor selector into filtering analysis and provides a detailed explanation of why such factoring is problematic, is something I'll ask and then leave it to others to decide about...
