Hi; The short answer is that all instances are grey and there may be different avenues or ways to deal with each issue - creative ways.
But, essentially, I would contend that a domain name is like any other piece of property or holding of the estate. That is, if one is to claim ownership or rights over something that is part of the deceased's estate, then they would need to prove/show that they are entitled to the property via documentation, a Will etc. With domains, since there is a registrant (in the form of a company) listed (in most cases) as well as a person, there are two entities that can be called upon to show authority, so one may have more than one avenue to authorize change or access.
