A few other things to consider here - 1) RSP to RSP transfers have always abided by this rule - 2) if transferring a name while on 'hold' the DNS will not function until the name has completed it's transfer and the whois CANNOT be modified while the name is in 'pending transfer' status - 3)if a name is in 'locked' status clientTransferProhibited then no transfer will occur.
