I don't think S3, VIA and friends even know who actually owns it right
now.

You need to distinguish between:
        An implementation of S3TC compression
        A tool that is using existing licensed S3TC compression aware hardware

The former is certainly covered by the patent. The latter does not seem
to be, no more than say an X86 application violates patents on aspects
of x86 CPU design

If someone can precisely define what the patch has in it and the patent
numbers again (I lost them) I can see if our patent/legal people will
take a look at that aspect and give an opinion
