Disclaimer: IANAL, and I don't handle abuse cases on LJ (or on DW, obviously). Take the following with appropriate amounts of salt. If you mean, "who will the DW or LJ TOS enforcers listen to in case there's a dispute", my guess is the copyright holder, which barring a copyright transfer is the author of each comment.
