Ecolog:

I'm confused again (I hope this isn't permanent).

Wonder what the relationship is between TLC of McHenry County (a non-profit) and Glacier Oaks Nursery.

I wonder what is "unique" about the "successful community based oak regeneration project in northern Illinois.

I used "air-pruning" containers, for example, in the 1970's and it never occurred to me to trademark the "program." Even though I originated various "programs" and techniques, I never tried to patent or otherwise protect my intellectual property other than through publication (which is subject to fair-use provisions of the law, so the transmittal of the information is not barred for personal use, only commercial use). I did find that government agencies and private companies did use my methods and even reprint my copyrighted material for profit, and to my detriment so I am not unsympathetic to the need to provide protection against misrepresentation, but I never tried to sue for such. The biggest problem was not so much that they made money with my intellectual property, but that they besmirched my reputation in the process by implying or stating that I was involved in their projects--to the point that a government agency threatened me because of a project with which I was never involved. Gossip went around that "the Tyson Method" (I never referred to it as such) was "no good" because when they tried it, it didn't work (they made serious errors).

I believe in the free sharing of the results of scientific and applied research. A. H. Maslow once said that, (I'm paraphrasing) while he worried in his youth that someone would steal his ideas, he finally stopped worrying since those who are so incompetent that they have to steal the ideas of others screw things up so badly that resemblance to his original idea was barely recognizable. That didn't help me salvage the parts of my reputation that was so tarnished for the very reason that the plagiarizing "interpreters" covered their own posteriors by pointing at the "Tyson Method" when anything went wrong, thus saving their own reputation by damaging mine. What amazes me is how gullible people and institutions are with respect to gossip, especially in that it never occurs to them to contact the originator; it's easier to believe and conduct a kangaroo court--if they conduct any enquiry at all.

Have others had similar experiences?

PS: An ex-associate once told me that his major professor once rejected a paper he had submitted explaining his research results which reached some hitherto unpublished conclusions; he later read his own work, published under his professor's name, in a respected journal. He got his Ph.D. but he kept quiet about the theft. In this case, the professor was able to understand the material well enough that he didn't screw it up.

To Dr. David Anderson and all,

Please see trademarked program of The Land Conservancy of McHenry County,

³Project Quercus² and ³Third Generation Oak Fund² at

--a unique and successful community based oak regeneration project in
northern Illinois.

I am propagator for Glacier Oaks Nursery, actively involved in preserving,
propagating and planting oaks for more than 25 years. We collect locally,
propagate and grow in air-pruning containers and plant out successfully
small oak seedlings for this program.

There are multiple methods used in the trade today to overcome many of the
oak growing and transplanting difficulties, some have been addressed in the
answers to your original post.

Please feel free to give me a call or send an email to my address below if
you have any further questions after looking at the above-mentioned website.
By the way, I¹m from the west too (Montana, Glacier National Park)!

Sincerely,

Mary Tree McClelland
