If a Democrat had been governor of Florida, the Republicans would be
making the same complaints as the Democrats do now because Buchanan
would have gotten many votes intended for Bush. The ballot was illegal
under Florida law, no matter who approved it, no matter whether it had
been used before, no matter what instructions it had. Florida law
specifies that the holes must be to the right of all of the names (they
are not on this ballot) and that the first two slots must be for the two
major candidates (they were not, because Buchanan occupied the second
punchable hole). You have to deal with the fact that the ballot was
illegal before you can appeal to other things.
Your argument does not convince.
