I don't mind everything being a search under the hood as long as I don't have 
to be aware of it. To me, if it looks like a folder, then I'm going to treat it 
as one and won't expect any quirks due to underlying implementation. 

If it looks like a smart folder, then all bets are off IME :)

The main problem with smart folders/live queries is how much slower they seem 
to be. Even iTunes shows me a "normal" playlist much faster than a smart one. 
The speed different in Mail is just embarrassing. I have one that takes over 10 
seconds the first time I enter it per session and over 1 second every single 
time I go into it! (i.e. it's long enough that I see the "spinner" every time I 
click on it and it's one reason, I like multiple windows)

Definitely a requirement. iTunes allows this with its smart playlists and Mail 
does in its Smart Mailboxes. I have to admit that I quite like iTunes' smart 
playlist creation system as it find it quite intuitive to create quite complex 
rules and the complexity is generally hidden for the trivial filters.
