When one Member State fails to implement a Directive then that MS looks to be acting in a tardy way. But when multiple MSs fail to implement the same Directive then that draws into question as to whether the Directive was really thought through before it was published in the OJEC. So who drafted the legislation in the first place and who decides whether to prosecute?
