Thanks for the response. I’m really trying to understand what the presumption of conformity means, so I’d like to understand where your understanding of the use of EN 300 440-2 comes from? Is it from a formal interpretation/ decision making document from the EU or other organisation? If yes, is the document publicly available? If yes can you send a link? It may not be. It may be your understanding derived from discussions with colleagues, but if there’s a document I’d like to read it :) If I take the wording of the RED at face value then EN 300 440-2 is a harmonised standard and under Article 17.3 I should be operating within the rules of the RED to use the Annex II, internal production control route to demonstrate compliance with articles 3.2 & 3.3. This way may not give me a presumption of conformity but isn’t that more about if there’s an investigation I would be obliged to demonstrate my product did comply rather than for a complainant to prove the product does not comply. Like being presumed innocent, the prosecution has to prove guilt, the defendant doesn’t have to prove innocence. OR is it the presumption of conformity associated with a harmonised standard that determines the conformity assessment procedure? However, if you have a receiver-only or transceiver device; you will need a Notified Body because the standard does not give presumption of conformity to the Directive (effectively, the receiver parts aren’t on the OJ).
