Thus far SCO have refused to show anyone what lines of code are at issue so I don't understand how you can make that judgement

It's a valid suit, assuming that there are line by line similarities in the source code. The bigger issue with it is what constitutes copyright infringement in software development. That's the sticky question to answer.
