Do you have the request come by written or verbal?  I never thought
about these consequences and now am wondering if I should ask for a
written request.  I talked to HR and asked them to find out what I need
to do.

In the United States, I know of no case law which even suggests that

is an unlimited right to privacy in a corporate environment.  Every case
I've ever heard of has been decided that a company has the right to look
at
emails on its own system.

If there is a corporate policy in place which explicitly states that
there
is no right to privacy, then you're pretty much good to go.

I didn't say I agree that this is how it should be.  I joined the EFF
within
days of Kapor and Barlow founding it - but that is how the US law is
right

In my company - a Fortune 500 company - messaging admins go into
people's
mailboxes if there is a valid business need to do so, but we don't ever
do
so unless we have a business reason, for example, fixing a rule,
checking on
a suspicious attachment, etc.  All requests by managers for monitoring
of
employees, we require that they come from HR through the Director of IT
down
to our group.  In addition, Union Contracts can give specific protection
to
union employees, although our union employees have no such additional
protection.

The point is, you want to make certain you have well-documented
procedures
in place, so that you can CYA against attorneys or managers who want you
to
take the blame.  None the less, the current state of US law is that
email in
the workplace is owned by and may be reviewed by the employer.

if you have mailsweeper you can create a custome archive to copy every
mail
in and out to a specified mail account.

Thanks for the Advice.  I will make sure that I get it in writing to do
that.  I didn't of it as being against the law as the Company owns the
email system.

The law varies from State to State and Country to Country. Best practice
is get advice from counsel. Don't do it without something in writing.

Were do you get the information that it is criminal?  I certainly don't
agree with it, but my understanding is that current case law (at least
in my
state) actually supports that if it is a business account the business
is
who owns it.

I agree this could turn nasty on you, dont do it, make sure you have it 
in writing and signed by the management first before you even attempt
this.
Trust me when it goes down and you dont have it in writing they will 
take you with them. After all you are the tech that "advised" them this 
was possible, at least that is the way it will sound when they get 
dragged through court.

It is a criminal offence to read someone elses email without thier 
consent, or a warrant.
