Ah but the problem with your last scenario is that if management do find out that you knew about this subscription, then they would have your ass in a sling.  My personal tack here is to document the evidence ( just some notes, along with copies of the email stored in a safe place) and then have a quiet word to the perpetrator letting them know that you know about their subscription and that you suggest they unsubscribe with their work address and subscribe with a Hotmail or Yahoo address.  Also remind the perp about your company policy on web and email access ( you do have one that new employees are required to read and sign, don't you?) and that this is likely to be a transgression and a possible cause for dismissal. 
 
I've only had to mention this to a couple of staff and the word soon gets around that you can check up.  Whether you do or not, the mere impression that email can be checked ( I only do this when management decides it is time for a witch hunt) is enough to make most people at little more careful about what they are looking at and subscribing to.  Besides it is always important to CYA.  ( cover your ass) in case these things come back to haunt you. Paranoid maybe, but I've been yelled at enough times by irate managers to always want a little ammunition to fight back with.  The benefit comes when the dirt is actually on the manager themselves ;)

This actually came up recently w/regards to web surfing patterns.  I did the research, passed along the restrictions, and recommended that there were better uses of our computing resources than attempting to determine how much time is spent web surfing.  If the work is getting done on time and well, that's the bottom line importance... If it isn't, corrective action should be taken.
 
And, yes, I've also done sleuthing for HR and Mgmt. w/regards to Per-Incident verification of questionable comments and usage.   There is one user in my organization who has an e-mail subscription to a "questionable" list which bounces and gets dumped in the Postmaster account.  I have not approached Mgmt. regarding this for the simple reason that information regarding this employee has not been requested.  My thinking is that I can be a policeman when necessary, but it is NOT my primary job responsibility.  If I were our organizatins security officer, it would be different.
