We have been caught twice by them for minor stuff that should never have been flagged. We did not pay them anything and in fact had our hosting provider threaten them with legal action for one offense. Sometimes it helps if you sign up for an account on their site and then you can request to get off the listing.
We have found that this affects our European offices more than North American as many businesses over there subscribe to Backscatter.org for RBL access/protection.
