Excellent catch! We just did an upgrade of one ML 8.1 machine and experienced the same problems with Apache. A look in the /etc/httpd/conf/ has the old files and the new files for the new install. The configuration files for the new installation (Upgrade) are identified as httpd.conf.rpmnew and httpd-perl.conf.rpmnew. Saving the old config files and renaming the *.rpmnew files to the correct httpd.conf and httpd-perl.conf corrects the problem. Changes to the commonhttpd.conf was not required.
