Oh, I see there's a link to the "cease and desist" letter on the JibJab website:

<http://www.eff.org/IP/20040727_jibjabthreat.pdf>

This is really classic comedy:

We are litigation counsel for Ludlow Music Inc. ("Ludlow"). We have reviews your letter to our client dated July 21, 2004.

As you are aware, Ludlow is the exclusive copyright owner of the the classic folk song "This Land Is Your Land" written by the well-known folk artist Woody Guthrie (the "Infringed Composition").

[...]

Instead, Jib Jab attempts to hide behind the purported defense that the Unauthorized Movie constitutes a parody. Make no mistake, while the Unauthorized Movie may be a humorous comment on the current presidential campaign, it does not meet the legal requirements for a parody of the Infringed Composition.

This is great stuff. If it's true that the vultures at Ludlow not only got laughed out of court, but actually *lost* their (one presumes very lucrative) copyright on Guthrie's song, well glory halleluia, there *is* some justice in the world after all.
