No, it isn't. apt was fixed for 3.3 and added to unstable within about 18 hours of the 3.3 release.

Sure but the unstable package is not yet in the bootstrap, is it? Regardless, using Fink with 3.3 is not recommended unless you know what you're doing, and I don't know that it will ever be officially "supported" on Jaguar without a lot of testing (although clearly we'll fix things as we find them). The new dev tools are not meant as a "for production" set of tools on Jaguar, they're to let developers get early warning on changes they need to make for Panther, which, because of binary compat issues, will need to be a new tree for Fink I assume.
