Maybe not, but the courts will have to give reasons and those reasons will but
subject to critique in the mountains of legal literature.
Maybe I'm being too optimistic when I suggest it might elevate the discussion,
but whether or not it elevates the discussion it produces answers and gives the people
who don't like the answers a clear cut line of attack, either by nuanced litigation
strategy or by constitutional amendment.
This list is one of the few places where the debate gets above reciprocal
sloganeering now. We could hope for better.
