It really works all the time.
I have never seen this problem personally so I can only speculate, but I wonder if something like the following is happening.
If your sound card/driver is slightly broke/non-functional with respect to OpenAL, but working enough for OpenAL to think it is good ...
Then copy #1 would open startup and try to do sound.
Copy #2 would also startup, it would see that the sound card is busy, and skip trying to do sound.
Close copy #1, and copy #2 continues to run happily (but minus sound.)
I'm just guessing here ...
