No. *Using* apack is not restricted at all. You may apack all your FreeDOS executables. It's the *distribution* that is (likely) restricted by the GPL.

You may even (subject to APACKs license) distribute:
* kernel.exe
* exeflat.exe
* apack.exe
then allow the user to apack and then exeflat the kernel. Now aggregation
applies. Sounds ridiculous? Maybe. But you have to realize that the FSF
has an agenda too, which likes to minimize the use of closed source
software. Which such a technique it becomes crystal clear to the user that
a non-free packer is involved.

Yes and no. If it has to be myself who had to solve this problem, I would include those three, then insert the command in the post-install script to silently apply the patch once installed. A way to have lawyers happy, and at the same time have what you want to have.
I agree with Lucho that it is absurd that we want to do such things because of the license.
By the way, I assume from this all that there's no GPL-ed packer. So I suppose that according to the FSF agenda this means that, as there is no GPL-ed packer, then I have to give up the ussage of packers, better than using a closed source one.

In this discussion, perhaps I am confused, but (just to mention two) Alain and Bart seem to be defending different positions. I wish this could be clarified and am grateful for the contributions, but if Bart is right, I definitely would like to take part in the creation of an alternative license that would avoid this.
Of course, one can't apply this to kernel, as Bart pointed out, but yet for whoever wants to use this for his/her utilities.

Regards,
Aitor
