Are you perhaps confusing the separate terms "SS" and "Spread Spectrum" ? They 
have different meanings in Part 97.
The SS definition you quoted defines the limited sub-set of Spread Spectrum 
emissions which CANNOT be used below 222 MHz but can be used above that 
frequency.

Those Spread Spectrum emissions which are NOT "SS" are permitted on all bands 
subject to ยง 97.309
