Then I think it's a breach of contract case nad not a
copyright issue.

Even if there was only an oral agreement for the
client to pay the developer for the work, that can
stand up in court.

But then again...I'm not a lawyer and this ain't elgal
advice. (My lawyer told me to say that...;-) )
