To the OP, the eject software that goes into your control strip works well, I think someone has given you a link to get it... I had this problem recently. The eject key on my keyboard works after a certain version of X is installed and only in X.

A trick I invented in desperation was to hold mouse down on start up (it will open) and pop any CD in. Push it in. Leave it. You can eject it because it is there! (select and command e or drag to trash). Use it as dummy for the tray. When you need to put in a useful CD you can. The point is to always have one in. You do not need to do the mose hold next time you start as long as you have left in a CD from your last session.

(BTW, I miss my keyboard "power on" button, have to bend over - ouch - to my near floor tower! Have not got a trick for this yet.)
