There are confirmed top-posters (disgusting as this may be) on every list who are well aware of what they are doing and who could care less about netiquette. IMO, the proper way to handle this would be to include a brief section (not a lengthy harangue) in the mail list FAQ (3. Gentoo Linux Mailing List Mini-FAQ) and to add a pointer to the FAQ in the welcome and confirmation messages generated by ezmlm/idx when a new user subscribes.
