Sure, maybe not in the final release, but it is in in the build 
environment. And it prevents me from running Geotools xml tests in 
eclipse and also leads to problems when the parser is used in GeoServer 
tests.

Oh well... just yet another hurdle i guess for people to develop with 
geotools... as if it was not hard enough already.
