If Wahl is still creating neighborhood boundaries I think the burden of
proof would be his. I believe he would need to show that he was using a
different method to create the same data.

What would happen if using different methodology I arrived at identical
or nearly identical neighborhood boundaries?  Would that be
infringement?  

Also, for me, the core question of the case is whether Wahl is being
sued for using the same methodologies he was contracted for or that he
continues to define neighborhood boundaries?
